1. Definitions

• Buyer: A registered user placing bids on listed items.
• Seller: An individual or company listing items on Spotter.
• Listing: Any item uploaded for auction.
• Security Deposit: A refundable deposit required to activate bidding.
• Auction: The online timed bidding process managed by Spotter.
• Item Release Form: A document issued by Spotter after payment, containing seller contact details and pickup instructions.

2. Account Registration

2.1 Users must register using accurate and complete information.

2.2 Users must be 18 years or older.

2.3 Spotter may request identity verification documents at any time.

2.4 Users are responsible for securing their login credentials.

2.5 Spotter may refuse or suspend registration at its discretion.

3. Security Deposit (10%)

3.1 Buyers must place a refundable security deposit equal to 10% of their bidding limit. Example: Bidding limit OMR 3,000 → Required deposit OMR 300.

3.2 The deposit is used to:

• Verify user identity
• Ensure bidding fairness
• Prevent default after winning

3.3 Refund Timeline:

• If the buyer does not win: deposit refunded within 3 working days, minus any bank charges.
• If the buyer wins: deposit remains refundable and will be released after full payment is confirmed.
• If the buyer defaults: Spotter may deduct charges from the deposit.

3.4 Spotter may temporarily hold or deduct part of the deposit for:

• Non-payment
• Violations of T&C
• Failure to remove items
• Damage caused during removal
• Fraudulent activity

4. Seller Listing Process

4.1 Sellers must submit accurate item details and documentation.

4.2 Spotter performs an inspection and prepares a professional listing.

4.3 Spotter may adjust listing descriptions based on inspection findings.

4.4 Sellers agree that Spotter’s inspection is independent and non-negotiable

5. Bidding Rules

5.1 All bids are final, binding, and cannot be withdrawn.

5.2 Buyers must review all inspection reports, media, and listing details BEFORE bidding.

5.3 Buyers must ensure they have sufficient funds to complete the purchase.

5.4 Bid increments apply as shown on each item page.

5.5 Spotter may restrict or suspend bidding privileges at any time.

6. Dynamic Closing (3-Minute Extension)

6.1 Any bid placed within the final 3 minutes resets the timer to 3 minutes.

6.2 Extensions continue until no further bids are placed.

6.3 This ensures fairness and prevents last-second bidding.

7. Auto-Bid (Proxy Bidding)

7.1 Buyers may set a maximum bid amount.

7.2 The system automatically bids only when needed.

7.3 Auto-bid will never exceed the preset limit.

7.4 Buyers pay the lowest winning price, not necessarily their maximum limit

8. Winning an Auction

8.1 The highest bidder wins, subject to seller approval where applicable.

8.2 Spotter notifies the buyer once the sale is approved and confirmed.

8.3 Buyers are legally bound to complete the purchase once approved.

9. Payment

9.1 Winning buyers receive a purchase invoice.

9.2 Payment must be completed within 3 working days.

9.3 Accepted payment methods are listed on the invoice.

9.4 Failure to pay may result in:

• Deduction from the security deposit
• Loss of bidding privileges
• Account suspension
• Cancellation of sale
• Re-listing the item at the buyer's risk

10. Item Pickup & Removal

10.1 Items remain at the seller's premises until collected.

10.2 Buyers must remove items within the timeframe set by the seller.

10.3 Buyers are fully responsible for:

• Transport
• Loading
• Labor
• Safety
• Required tools or equipment

10.4 Spotter is not responsible for removal, loading, damage, or delays

10.5 Late removal may result in:

• Storage fees
• Penalties imposed by the seller
• Restricted account privileges

11. Item Condition & Buyer Responsibility

11.1 All items are sold AS-IS, WHERE-IS, with no warranties, expressed or implied.

11.2 Buyers accept all defects, faults, and conditions of the item.

11.3 Spotter inspection reports are provided for convenience only

Spotter does not guarantee

• Accuracy of reports
• Hidden defects
• Mechanical performance

11.4 By bidding, buyers confirm they have:

• Reviewed inspection materials
• Conducted their own inspection or waived it
• Accepted the item's condition

12. Documentation & Ownership Transfer

12.1 Sellers provide available documents; completeness is not guaranteed.

12.2 Buyers are responsible for:

• Registration
• Export
• Customs procedures
• Transfer of ownership
• Government approvals

Spotter is not liable for document-related delays or issues

13. Seller Responsibilities

13.1 Sellers must legally own the item.

13.2 Sellers must disclose known defects, debts, or liens.

13.3 Sellers must provide access for inspection and pickup.

13.4 Failure to disclose material issues may result in penalties.

14. Spotter Responsibilities

Spotter acts only as an intermediary connecting buyers and sellers.

Spotter is not:

• The owner of listed items
• Responsible for item condition
• Responsible for removal or transport
• Liable for inaccurate seller information
• Government approvals

15. Limitation of Liability

Spotter is not liable for:

• Mechanical issues or hidden defects
• Misrepresentation by sellers
• Loss of profit
• Delays or disputes between users
• Damage during loading or transport
• Failure to complete transactions

Users agree to indemnify Spotter against all claims arising from platform use

16. Account Suspension

Spotter may suspend or terminate accounts for:

• Non-payment
• Fraud or suspected fraud
• Abusive behaviour
• Repeated violations
• Chargebacks
• Failure to remove items on time

17. Governing Law

These Terms & Conditions are governed by the laws of the Sultanate of Oman.

All disputes shall be resolved exclusively under Omani jurisdiction.

18. Acknowledgment

By using this website, registering, bidding, or browsing, you confirm that you have read, understood, and agreed to these Terms & Conditions and all other policies published by Spotter.
